Conditions of entry

VEHICLES ARE ACCEPTED FOR PARKING AND PERSONS MAY ENTER THE CARPARK ONLY ON THE FOLLOWING CONDITIONS:

If you do not accept these conditions, please immediately leave the Carpark. If you are in a vehicle and have entered the Carpark, drive directly to the nearest exit where you may leave without charge provided you exit within 10 minutes of entry.

  1. The following will be Acts of Default:
    1. parking in an area marked as a "No Parking" or "Unauthorised Parking Area" or an otherwise reserved area;
    2. obstructing any other vehicle;
    3. failure to comply with any signs or any reasonable direction or request made by us;
    4. leaving a vehicle in the Carpark for in excess of 4 weeks without prior notice to the operator's agents at Biggles Coffee Lounge in the airport terminal;
    5. failure to pay the parking fees applicable at any material time.
  2. If an Act of Default occurs, we have the right to:
    1. affix a notice to the defaulting vehicle;
    2. enter, move or tow that vehicle away at your risk and expense regardless of whether or not the vehicle is locked; and/or
    3. hold that vehicle in storage or otherwise until all charges for parking, moving, towing and storage are paid to us;
    4. request that the relevant authority remove your vehicle from the Carpark and/or impound your vehicle.
  3. We reserve the right to refuse entry to any vehicle or person.
  4. You may gain access to or remove your vehicle only during the hours we display in the Carpark.
  5. You may use the Carpark at your risk and release the operators to the full extent permitted by law from all claims, demands, actions or suits resulting from any death or injure to any person or loss or damage to any vehicle, accessories, goods or property or arising directly or indirectly from your use of or presence (or your vehicle's use of or presence) in the Carpark, whether such death, injury or loss or damage was caused or contributed to by us, our servants or agents or any vehicle or otherwise.
  6. You agree to indemnify (and keep indemnified) us, our servants or agents from and against all actions or claims arising in any way from the parking, storing or driving of your vehicle.
  7. You are at all times a licensee only and nothing in this agreement or the parking of a vehicle in the Carpark constitutes us as a bailee of your vehicle.
  8. You must pay the fees set by us from time to time to park your vehicle in the Carpark.
  9. To exit the Carpark, please pay the appropriate fee at one of the Parking Pay Stations in the airport terminal where your ticket will be validated for pedestrian entry to the Carpark and for your vehicle exit.
  10. If you lose your ticket we reserve the right to charge you an administration fee of one day's parking in addition to any other fees otherwise payable.
  11. If we move your vehicle these conditions continue to apply. We are not liable for any damage caused to your vehicle when we move it.
  12. If you fail to pay us, we will issue a written demand to you. If the outstanding fees and expenses are not paid within 30 days of service of that demand, we may sell your vehicle to recover money owed to us. In selling, we may proceed in a manner as we think fit in our absolute discretion and we will not be obliged to obtain the best price.
